Language:

These Terms of Service govern access to and use of Class Quantum by customer organizations or tenants, including schools, training institutions, bootcamps, learning communities, and other education providers.

By accepting these Terms, the organization representative confirms that they have authority to bind the organization. If you do not have that authority, do not accept these Terms.

1. Scope of the service

Class Quantum provides software that supports education and operational management, including users, classes, attendance, assignments, exams, grades, reports, files, communications, and related features. Available features may vary by plan, region, tenant configuration, and product development stage.

2. Accounts and organizational authority

  • The organization is responsible for providing accurate registration information and appointing authorized owners and administrators.
  • The organization is responsible for roles, access permissions, credentials, and the actions of users within its tenant.
  • Credentials must not be shared with unauthorized parties. Suspected misuse must be reported promptly.
  • An owner accepting these Terms confirms that they are authorized to act for and on behalf of the organization.

3. Acceptable use

The service must be used lawfully, reasonably, and for the organization's educational or operational purposes. The organization must not use the service to infringe the rights of others, distribute malware, attempt to breach security, disrupt the service, send spam, or process data without a lawful basis.

4. Organization data and content

The organization retains its rights in data and content submitted to the platform. The organization grants the Provider a limited right to store, process, transmit, back up, and display that data only as necessary to provide, secure, support, and improve the service.

The organization is responsible for ensuring that uploaded data is lawful, relevant, accurate, and does not infringe the rights of others. Data processing arrangements are described further in the Data Processing Addendum.

5. Children and student users

The organization is responsible for establishing an appropriate lawful basis for children's or students' data, including notices to parents or guardians and consent where required by law. Student accounts may only be issued to users entitled to access them.

6. Plans, fees, and service changes

Fees, quotas, trial periods, taxes, payment methods, and billing terms are governed by the order form, proposal, invoice, or plan page accepted by the organization. Third-party charges may apply to certain features.

The Provider may update features for security, compliance, quality, or product development. Where reasonably possible, the Provider will give notice of material changes that significantly reduce paid functionality.

7. Third-party services and artificial intelligence

Some functions may depend on cloud, storage, email, payment, analytics, automation, or artificial intelligence providers. AI output may be incomplete or incorrect and must be reviewed by a person before it is used for important decisions. The organization must not use automated output as the sole basis for decisions that significantly affect students or staff.

8. Security and availability

The Provider applies safeguards that are reasonable for the nature of the service. However, no system is entirely free from disruption or risk. Maintenance, emergencies, third-party dependencies, and events beyond reasonable control may affect availability. The organization remains responsible for its internal procedures and any copies of important data required for its operations.

9. Suspension and termination

Access may be limited or suspended due to a security risk, legal violation, misuse, material non-payment, or breach of these Terms. After the relationship ends, data export and deletion are governed by the agreement, retention policies, legal obligations, and the Data Processing Addendum.

10. Intellectual property

The Provider and its licensors retain all rights in the platform, trademarks, designs, code, documentation, and service technology. No rights are transferred other than the limited right to use the service while the organization remains entitled to access it. Product feedback may be used to improve the service without disclosing the organization's confidential data.

11. Limitation of liability

To the extent permitted by law, the service is provided as available. The Provider is not liable for indirect loss, lost profits, or educational decisions made without human review. The Provider's aggregate liability for claims related to the service is limited to the fees paid by the organization for the service during the twelve months before the event giving rise to the claim, unless applicable law prohibits that limitation.

12. Governing law and dispute resolution

These Terms are interpreted under the laws of the Republic of Indonesia, without limiting mandatory rights granted by law in the organization's location. The parties will first attempt to resolve disputes through good-faith communication and consultation before bringing proceedings before a court or other competent forum.

13. Changes to these Terms

The Provider may update these Terms. Material changes will receive a new version and require renewed acceptance by the tenant owner. Administrative changes or clarifications that do not materially reduce rights may take effect when published.
